1. About The Bat Witch Cavern

The Bat Witch Cavern is a sole proprietorship owned and operated by Shara Rumbolt, carrying on business as The Bat Witch Cavern. In these terms, “we,” “us” and “our” refer to that business. Our website is www.thebatwitchcavern.com, and our online store is hosted on Shopify.

These terms govern use of our website and purchases from us. Our Shipping & Local Pickup Policy and Return & Refund Policy form part of the terms of your purchase. Our Privacy Policy explains how we handle personal information.

Our store welcomes everyone. We do not impose a general 18+ shopping restriction. If you are not legally able to enter into a binding purchase agreement yourself, a parent or guardian must make or authorize the purchase. Access to the store does not mean that every product is suitable for children.

Power Up Gaming provides mail forwarding and collection of completed pickup orders only. It is not the seller of The Bat Witch Cavern merchandise and does not handle our refunds, credits, returns or customer-service decisions. The forwarding address is not our operating business address or an authorized merchandise-return address. Obtain return instructions from us before sending merchandise.

3. Orders, payments and availability

Please provide accurate contact, billing and delivery information and use only a payment method you are authorized to use. Review the items, quantities, address and total before submitting your order. Contact us promptly about an error.

Prices are in Canadian dollars. Applicable taxes and shipping charges are displayed at checkout before payment. Promotions and discounts apply according to their stated conditions.

Inventory is limited while we liquidate the business. If an ordered item is unavailable, we will remove that item and refund the amount paid for it, including applicable taxes. If unavailability affects a substantial portion of the order, we will contact you to discuss the available options before proceeding with the remaining items. We will not substitute a different product without your agreement.

We aim to keep prices, descriptions and inventory accurate. If we discover an error affecting your order, we will explain it and discuss the appropriate correction or resolution. We will not automatically increase an agreed price or require you to accept a different item. Any proposed change to a paid order requires your agreement and must comply with applicable law.

We may decline or cancel an order where payment is declined, there are reasonable grounds to suspect fraud or unauthorized payment, or fulfilling the order would be unlawful. Any funds collected for merchandise we do not supply will be refunded as required by law. These provisions do not give us an unrestricted right to cancel a binding order merely because its price is inconvenient.

4. Product descriptions and natural variation

Crystals, stones and handmade or naturally sourced products may vary in colour, shape, size, pattern, texture and markings. We try to show representative variations in our photographs, but photographs cannot show every possible variation. Screen settings may also affect the appearance of colours.

Unless a listing expressly identifies the exact individual item pictured as the item being sold, images illustrate the product or its typical range of variations. Any stated dimensions, quantities, materials, treatments and other express product descriptions still apply.

Natural variation does not excuse a materially inaccurate description, an undisclosed substitution, or damage. Contact us if you believe an item does not match its description.

5. Spiritual and metaphysical information

Descriptions of spiritual, energetic, symbolic or metaphysical properties reflect traditions, beliefs and personal practices. They are not promises of measurable results. We do not guarantee that a product will produce healing, protection, luck, financial gain, relationship changes or any other particular outcome.

Our products and website content are not medical advice or a substitute for professional diagnosis or treatment. We do not sell these products to diagnose, treat, cure or prevent disease. Statements about spiritual traditions do not limit our responsibility for accurate factual descriptions of the goods we sell.

6. Intended use and product care

Follow the product label, manufacturer instructions and warnings. Use each product only for its stated purpose. We do not sell products intended for consumption or application to skin. Do not eat, drink, smoke or ingest our herbs, oils, crystals or other merchandise, use them to prepare consumable mixtures, or apply them to your skin or body.

For candles, incense and products intended to burn:

• Never leave burning or smouldering products unattended. Extinguish them before leaving the area or going to sleep.
• Use an appropriate, stable, heat-resistant holder on a heat-resistant surface, away from flammable objects and drafts.
• Keep flames, hot wax, embers and burning products away from children and pets. Allow holders and ashes to cool before handling or disposal.
• Follow any wick-trimming, burn-time and clearance instructions supplied with the product. Do not add oils, herbs, crystals or other materials to a flame or candle unless the product's instructions expressly permit it.
• Use ventilation and avoid exposing people or animals to smoke or fragrance that causes irritation. Stop use if irritation occurs.

Do not burn a product simply because it is an herb or oil. Burn only products specifically intended for that use and follow their instructions. Keep small items, oils and other potentially hazardous products out of reach of children and pets. Natural origin does not guarantee safety.

These precautions supplement product-specific instructions; they do not replace required warnings or excuse an unsafe or defective product.

7. Shipping, pickup, returns and refunds

We ship within Canada only. Orders for shipment or local pickup are prepared once weekly, within 5 business days after payment, excluding weekends and Ontario statutory holidays. Carrier transit time is additional.

Our Shipping & Local Pickup Policy explains courier selection, shipping-price discrepancies, pickup identification, the 60-day collection period and returned shipments. Our Return & Refund Policy explains return approval, resellable condition, the requirement to receive voluntary returns within 30 days, shipping costs, refund processing and product-issue claims.

The specific policy governs its subject if it conflicts with a general statement in these terms. A specific written arrangement agreed with you governs the affected order, subject to applicable law. Nothing in these terms converts a promised refund into store credit without a valid basis.

8. Liquidation and store credits

The Bat Witch Cavern is liquidating its remaining inventory and will permanently close. A liquidation discount does not, by itself, make merchandise final sale or remove an existing return entitlement.

Merchandise-credit redemption and closure notices are governed by the Shipping & Local Pickup Policy and the terms applicable when the credit was issued. Purchased gift cards and genuinely free promotional offers are treated separately. Closure does not override legally enforceable customer rights.

9. Website use and intellectual property

Do not use the website to commit fraud, transmit malicious code, attempt unauthorized access, interfere with store operations, impersonate another person, or infringe another person's rights. We may restrict access reasonably necessary to address such conduct, without removing valid rights connected to an existing purchase.

Website text, photographs, graphics, branding and other original content belong to The Bat Witch Cavern or their respective owners. You may use the site for shopping and retain copies of product information, policies and transaction records for personal use or to exercise your rights. Commercial reproduction or reuse requires permission from the relevant rights holder, unless permitted by law.

Any review you submit must reflect your honest experience and must not disclose another person's private information or contain unlawful content. We may display a submitted product review with its chosen public display name for the purpose of operating our review feature. You retain ownership of your original review. Negative feedback is not prohibited merely because it is critical.

10. Third-party services and privacy

Shopify and payment, delivery and other service providers help us operate the store. Relevant provider terms may apply to their services, but they do not replace our obligations as the seller. Links to third-party websites do not constitute a guarantee of their content or services.

Personal information is handled as described in our Privacy Policy. Placing an order allows us to communicate with you as needed to fulfil and administer it; it does not by itself constitute consent to unrelated promotional emails.

11. Responsibility and consumer rights

We take reasonable care in operating the store but cannot guarantee uninterrupted website access or that every technical error will be prevented. We do not guarantee the spiritual or metaphysical outcomes described above.

Nothing in these terms excludes a warranty, condition, obligation or remedy that cannot lawfully be excluded. Nor do these terms release us from responsibility for our own unlawful conduct, defective goods or failures to meet applicable consumer obligations. Customers remain responsible for losses caused by their own misuse to the extent provided by law.

Please contact us first if there is a problem so we can try to resolve it. You retain any right to contact a regulator, pursue a lawful payment dispute or bring a claim in a court or other forum available to you. These terms do not require mandatory arbitration or waive class-action rights.

12. Governing law and changes

These terms are governed by Ontario law and applicable federal Canadian law, subject to mandatory consumer protections and jurisdictional rights that apply where you live. This clause does not require you to give up protections or access to a forum that cannot legally be excluded.

We may update these terms for future website use and purchases by publishing a revised version. The terms applicable when an order was placed continue to govern that order unless we agree otherwise with you in a lawful manner. An update does not retroactively reduce existing refund, credit or other rights.

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a term on one occasion does not automatically waive it on every occasion.
